1. Definitions

In these Terms:

• “Company”, “we”, “us”, “our” refers to Legacy Koi
• “Customer”, “you”, “your” refers to the purchaser or website user
• “Goods” means all products supplied, including live Koi
• “Contract” means any agreement between us for the sale of Goods

2. Basis of Contract

2.1 These Terms apply to all sales and website use and override any other terms.

2.2 By placing an order, you confirm that:

• You are legally capable of entering into a binding contract
• All information provided is accurate

2.3 A Contract is formed only when we dispatch the Goods.

2.4 We reserve the right to refuse or cancel any order at our discretion, including due to:

• Pricing errors
• Stock unavailability
• Suspected fraud

3. Website Use

3.1 You agree to use this website lawfully and not to:

• Misuse or interfere with its operation
• Attempt unauthorised access
• Transmit harmful or unlawful content

3.2 All intellectual property rights in the website are owned by or licensed to us.

3.3 You may not reproduce or exploit any content without written consent.

4. Product Descriptions

4.1 We take reasonable care to ensure descriptions are accurate.

4.2 However:

• Images are for illustration purposes only
• Live Koi are unique and will vary in colour, size, and pattern

4.3 Minor variations shall not constitute a defect.

5. Price & Payment

5.1 All prices are in GBP (£) and include VAT where applicable.

5.2 Payment must be made in full prior to dispatch.

5.3 We reserve the right to correct pricing errors at any time.

6. Delivery

6.1 Delivery dates are estimates only and time is not of the essence.

6.2 We shall not be liable for delays caused by:

• Couriers
• Weather
• Events beyond our reasonable control

6.3 Risk passes to you upon delivery or attempted delivery.

6.4 All deliveries must be signed for unless otherwise agreed.

7. Live Koi Sales (Important)

7.1 Live Koi are perishable, live animals and require special handling.

7.2 By purchasing live Koi, you acknowledge and accept:

• Delivery times cannot be guaranteed
• Fish may experience stress during transit
• Environmental conditions post-delivery are outside our control

7.3 All fish are health-checked prior to dispatch.

7.4 Risk passes to the Customer upon dispatch.

7.5 We shall not be liable for:

• Losses occurring after dispatch
• Issues arising from pond conditions, water quality, or acclimatisation

8. Koi Deposits

8.1 Deposits are non-refundable.

8.2 Full payment must be made upon completion of quarantine.

8.3 If collection is delayed, we reserve the right to charge £10 per week storage unless other arangments made in writing.

8.4 Failure to complete purchase may result in forfeiture of the deposit.

8.5 Risk transfers to the Customer following the quarantine period.

9. Title (Ownership)

9.1 Ownership of Goods shall not pass until payment is received in full.

9.2 We reserve the right to recover Goods where payment has not been made.

9.3 Goods not collected within 60 days may be treated as abandoned and no refund will be issued.

10. Inspection & Claims

10.1 You must inspect Goods immediately upon delivery.

10.2 Any:

• Damage
• Shortage
• Incorrect Goods

must be reported within 24 hours.

10.3 Failure to notify within this period may invalidate any claim.

11. Returns & Refunds

11.1 Returns require prior authorisation.

11.2 You must notify us within 7 days of receipt.

11.3 Returns are accepted up to 28 days, subject to:

• Goods being unused
• Goods being in original packaging

11.4 Non-Returnable Goods

Due to their nature, the following are excluded:

• Live fish
• Perishable goods
• Opened or used food, treatments, or chemicals

11.5 Costs

• Customer bears return costs unless Goods are faulty or misdescribed

12. Consumer Rights

12.1 Nothing in these Terms limits your rights under the Consumer Rights Act 2015.

12.2 Your cancellation rights under the Consumer Contracts Regulations 2013 may not apply to:

• Perishable goods
• Live animals

13. Limitation of Liability

13.1 To the fullest extent permitted by law, we shall not be liable for:

• Indirect or consequential loss
• Loss of profits, business, or revenue
• Loss arising from delays or third-party couriers

13.2 Our total liability shall not exceed the purchase price of the Goods.

13.3 Nothing excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation

14. Force Majeure

We shall not be liable for failure to perform obligations due to events beyond our control, including:

• Natural disasters
• Transport disruptions
• Supplier failures

15. Website Disclaimer

15.1 Content is provided “as is” without warranties.

15.2 We do not guarantee:

• Accuracy
• Availability
• Freedom from errors

16. Third-Party Links

We are not responsible for the content or practices of third-party websites linked from our site.
